Welcome to elevatedcolors.com (the "Site"), operated by Elevated Colors ("Elevated Colors," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of the Site. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Elevated Colors provides residential and commercial painting services in Winter Haven, Auburndale, Lake Wales, Dundee, and surrounding areas of Polk County, Florida. Requests from outside our service area may be declined or referred elsewhere.

You may use the Site to learn about our services, request estimates, and contact us. You agree not to:

• Use the Site for any unlawful purpose
• Submit false, misleading, or someone else's information
• Attempt to gain unauthorized access to the Site or its systems
• Interfere with the Site's operation, including through viruses, bots, or spam
• Copy, scrape, or reuse Site content without our written permission

Information on the Site, including service descriptions, pricing ranges, and "starting at" figures, is for general information only and is not a binding quote or offer.

• All estimates are provided after we review your project, and may change if the scope, conditions, or materials change.
• Painting work is performed only under a separate written estimate, proposal, or contract signed by you and Elevated Colors.
• If anything in that written agreement conflicts with these Terms, the written agreement controls.

Promotions shown on the Site (for example, new-client discounts) are subject to the conditions stated with the offer, such as minimum project size, eligible services, and expiration dates. Unless stated otherwise, offers cannot be combined, have no cash value, and must be mentioned at the time of estimate. We may change or end any promotion at any time.

Project photos, before-and-after images, and color examples on the Site show our past work and are for illustration only. Colors can look different on screens than in person, and results vary based on surfaces, lighting, and existing conditions. Always review physical samples before choosing final colors.

By opting in to text messages, you agree to receive texts from Elevated Colors about your inquiry, estimate, appointment, project updates, and, if you opted in, occasional promotions.

• Consent is not a condition of purchase.
• Message frequency varies. Message and data rates may apply.
• Reply STOP to cancel at any time. You will receive one confirmation message, and then no further texts unless you opt in again.

• Carriers are not liable for delayed or undelivered messages.

If you submit a review, testimonial, photo, or other content to us, you confirm that it is truthful and that you have the right to share it. You give Elevated Colors permission to use, display, and share that content on our Site, social media, and marketing materials, with your first name and city unless you ask us not to. We will not include your full address or contact details.

All content on the Site, including text, logos, graphics, photos, and design, is owned by or licensed to Elevated Colors and is protected by copyright and trademark laws. The Elevated Colors name and logo are our trademarks. You may not use them without our written permission.

The Site may include links to or features from other companies, such as review platforms, maps, scheduling tools, or color visualizers. We do not control and are not responsible for third-party websites or tools, and your use of them is subject to their own terms.

The Site and its content are provided "as is" and "as available." We work to keep information accurate and current, but we do not guarantee that the Site will be error-free, uninterrupted, or free of harmful components. Warranties for painting work are provided only in your written service agreement.

To the fullest extent permitted by law, Elevated Colors will not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Site. This section applies to your use of the Site only. Our responsibilities for painting services are set out in your written service agreement.

You agree to defend and hold harmless Elevated Colors, its owners, employees, and contractors from any claims, losses, or expenses arising from your misuse of the Site or violation of these Terms.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute related to the Site will be resolved in the state or federal courts located in Polk County, Florida.

We may update these Terms at any time. Changes take effect when posted on this page. Continued use of the Site after changes are posted means you accept the updated Terms.

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, are the entire agreement between you and Elevated Colors about use of the Site.
